In order to prevent illegal employment and unfair competition between companies, most employees in the building and civil engineering sector (BTP) must be identified by a professional identification card: the BTP Card. This secure individual card must be presented by the employee in the event of an inspection.
Beware! We have been observing an increase in inspections in the sector for some time now. Make sure that all your employees have the card, including temporary workers.
> Scope of application
All employees who carry out, direct or coordinate building and civil engineering work, even on an occasional, incidental or secondary basis, on behalf of a company (even if the company is not covered by the building and civil engineering collective agreements) established in France, or on behalf of a company established outside France in the event of posting, are covered by this obligation. Some limited exemptions are provided for in the law.
> Procedures
Employers must create an account on the https://www.cartebtp.fr/connexion.html portal to identify themselves and authorize the persons who will be responsible for managing BTP card applications and payments within the company.
Once registration has been validated, the employer must submit a dematerialized declaration to the fund each time a new employee is hired, in order to obtain the employee’s personal BTP card and pay the fee. Before making the declaration, the employer must inform the employee of the personal data transmission.
Special conditions apply to companies based outside France, and to companies using employees posted by foreign temporary employment agencies.
> Penalties
In the event of failure to comply with the duty to declare, the employer or, where applicable, the user company is liable to an administrative fine of up to €2,000 per employee, with a maximum total fine of €500,000.
