									<p><span style="color: #999999;"><em>Article of 15/03/2024 updated on 15/04/2026</em></span></p><p>Non-professional furnished rental (LMNP) is a tax status applicable to people who rent out one or more furnished accommodations, without carrying out this activity professionally.</p><p>It meets a precise definition and is subject to a particular tax and social regime but it offers attractive tax optimization, without the constraints of professional status.<br />We will briefly describe the rules related to this activity.</p><p>We will first give a definition of classified tourist accommodation, but you can however refer to our article entitled &#8220;<strong><em><span style="color: #2b7091;"><a style="color: #2b7091; text-decoration: underline;" href="https://www.frenchbusinessadvice.com/the-different-categories-of-tourist-accommodation-and-their-regulations" target="_blank" rel="noopener">The different categories of tourist accommodation and their regulations</a></span></em></strong>&#8221; on this website, in order to better understand the various forms of tourist rental.</p><p>To designate non-professional furnished rental, we will use the acronym &#8220;LMNP&#8221; throughout this article.</p><h4><span style="color: #2b7091;">I-DEFINITION OF L.M.N.P:</span></h4><p>• This is the<span style="color: #ff9900;"><strong> rental of apartments equipped with furniture</strong></span> and sometimes accompanied by services (guest rooms, residential hotels &#8230;). In those of an apartment rental, it must include all the elements necessary for normal occupation by the tenant. The list of these elements is provided by the decree N ° 2015-981 of July 31st 2015.</p><p>• <span style="color: #ff9900;"><strong>Furnished tourist accommodation means:</strong> </span>Individual accommodation such as a villa, apartment or furnished studio offered for rental. It must notably include the following equipment:</p><ul><li>Furniture</li><li>Bedding</li><li>Gas stove or hotplates</li><li>Fridge</li><li>Cooking tools.</li></ul><p>• <span style="color: #ff9900;"><strong>The contractual obligations of the furnished rental company:</strong> </span>The French Housing Act (ALUR) extended the following obligations, previously limited to unfurnished rentals, to furnished rentals for primary residences: Provision of &#8220;decent&#8221; housing, establishment of a written lease, provision of a technical inspection report to the tenant, and preparation of an inventory of fixtures.</p><p>However, a few specific rules for furnished rentals were introduced by the ALUR Act. These relate to the duration of the lease (one year for furnished rentals instead of three years for unfurnished rentals), the amount of the security deposit (two months&#8217; rent for furnished rentals instead of only one month for unfurnished rentals), and the notice period to be observed by landlords and tenants giving notice.</p><p>It should also be noted that there is a &#8220;mobility lease&#8221;, lasting a minimum of one month and a maximum of ten months, to allow rentals for people looking for temporary accommodation (apprentices, trainees, employees on temporary assignment, etc.).</p><p>Regarding these matters, the relationship between landlords and tenants of tourist accommodation continues to be largely governed by contractual freedom. However, the legislation requires landlords to provide prospective tenants with very detailed information about the property itself, its amenities, and its surroundings.</p><p>• <span style="color: #ff9900;"><strong>To obtain the classification of a furnished tourist accommodation:</strong></span> You must make a request to the accredited or approved assessing body of your choice (appearing on the lists on the “Atout France” website) using form No. 11819* 03.</p><p>It allows you to benefit from an additional tax reduction on rental income under the micro-enterprise scheme. It also allows you to join the National Agency for Holiday Vouchers (ANCV).</p><p>The assessing body visits the accommodation. In the month following this visit, he will give you a visit certificate including the inspection report as well as the proposed decision to classify the furnished accommodation for the category mentioned in the inspection report.</p><p>•<span style="color: #ff9900;"> <strong>Reporting obligations and administrative authorizations:</strong></span></p><ul><li style="list-style-type: none;"><ul><li>Individuals renting out furnished accommodation intended to be occupied as a primary residence by their tenant are not required to make any prior declaration to the town hall. However, some municipalities may establish a procedure for declaring the rental of accommodation for use as a primary residence, which applies to both unfurnished and furnished accommodation.</li><li>Regarding short-term or tourist rentals:<ul><li>If the tenant rents guest rooms (bed and breakfast), his administrative obligations are limited to a declaration at the town hall;</li><li>If the tenant rents furnished tourist accommodation (i.e., independent housing), two situations are possible:</li></ul></li><li>If the premises in question constitute their primary residence (i.e., accommodation occupied at least eight months a year), no declaration at the town hall is generally required (except in municipalities that have implemented a prior declaration procedure for furnished tourist accommodation).</li><li>If the premises in question are not their primary residence, a &#8220;simple&#8221; declaration or a declaration subject to registration is required in any case.</li></ul></li></ul><p>• <span style="color: #ff9900;"><strong>In terms of income tax, the furnished residential rental activity</strong></span> is carried out on a <span style="color: #ff9900;"><strong>professional basis (LMP)</strong></span> when the following two conditions are met (CGI article. 155, IV.2):</p><ul><li>The annual income (incl. VAT) withdrawn from the furnished rental activity by all the members of the tax household must exceed € 23,000;</li><li>This revenue exceeds the other income of the fiscal household subject to income tax in the categories of salaries and wages within the meaning of article 79 of the CGI (i.e. allowances, emoluments, salaries, pensions, life annuities as well as retirement benefits paid in the form of capital) , industrial and commercial profits other than those derived from the rental activity furnished, agricultural profits, non-commercial profits and the income of managers and associates mentioned in article 62 of the CGI.</li></ul><p>As a result, any person who rents furnished dwellings and who does not meet one of the conditions listed above is qualified as L.M.N.P.</p><p>• Nevertheless, L.M.N.P. must register as a non-professional at the registry of the commercial court on which the property depends.</p><p>• <span style="color: #ff9900;"><strong>Distinction between long-term rental from seasonal rental:</strong></span></p><p>A furnished rental is said to be seasonal when the accommodation is rented per night, week or month, and for a maximum period of 90 consecutive days, to passing customers who do not take up residence there.</p><p>When the accommodation is rented for a period of one year (or 9 months for a student) and the tenant makes it their main residence, this is referred to as long-term rental.</p><p>For residences with hotel services rented to an operator via a commercial lease, the owner of the accommodation is deemed to be doing long-term rental.</p><h4><span style="color: #2b7091;">II-TAX CHARACTERISTICS:</span></h4><h5><span style="color: #60bae3;">1. Exemption cases:</span></h5><p>Income from the furnished rental of part of the principal residence is not taxable in the following cases:</p><ul><li>When the rented rooms do not constitute the main residence of the tenant if the annual rental income does not exceed € 760. It can be an occupation by the day, the week, the month, etc.</li><li>When the rented rooms are the main residence of the tenant. In this case, the rental price must be lower than a threshold published each year by the administration.</li></ul><h5><span style="color: #60bae3;">2. Taxation schemes:</span></h5><p>All furnished rental income is taxable in the category of Industrial and Commercial Benefits (B.I.C.).</p><ul><li><strong><span style="color: #ff9900;">Micro scheme:</span></strong> The turnover thresholds below which BIC taxpayers are automatically eligible for this scheme, as well as the applicable tax reduction rate, are set respectively at:<ul><li>€15,000 and 30% for lessors of unclassified furnished tourist accommodation;</li><li>€83,600 and 50% for other lessors of furnished accommodation.</li></ul></li></ul><p>Thus, the €83,600 threshold and the 50% tax reduction rate particularly concern owners of furnished accommodation rented as a primary residence, owners of classified furnished tourist accommodation, owners of guest rooms, and taxpayers renting condominium units to operators of serviced residences.</p><p>The micro scheme only ceases to apply if the threshold is exceeded for two consecutive years.</p><p><span style="color: #2b7091;"><strong>Precision:</strong></span> The 30% and 50% deductions include all expenses including depreciation allowances. It cannot be allowed to result in a fiscal deficit.</p><p>• <span style="color: #ff9900;"><strong>Real scheme:</strong></span> This regime can be applied compulsorily (see above) or optionally. This can be exercised within the deadline for filing the overall income tax return.</p><p>This tax system allows the operator to deduct all expenses actually incurred as well as, when the building is listed as an asset, depreciation charges on all investments. The basis for calculating depreciation is the cost price of the rental accommodation, excluding the value of the land on which it is based.</p><p>There are two points to note, however:</p><ul><li>With the exception of lessors covered by the para-hotel regime (for whom the depreciation recorded is deductible without limitation of amount), the depreciation charge cannot exceed the difference between the total rents collected and the total of other expenses. This means that depreciation cannot generate a deficit. The non-deductible portion of depreciation can be carried forward without limitation.</li><li>In the event of a deficit, when the expenses are higher than the rents collected, this one can only be carried forward on the profits of the 10 following years of L.M.N.P.</li></ul><h5><span style="color: #60bae3;">3. Capital gains taxation:</span></h5><p>Capital gains made on housing transfers, only by furnished rental companies who do not have the status of professional furnished rental company are subject to the real estate capital gains regime. On the other hand, capital gains relating to other fixed assets such as furniture, as well as all capital gains made by furnished rental companies which fall under the para-hotel regime are subject to the professional capital gains regime.</p><ul><li><span style="color: #ff9900;"><strong>Capital gains subject to the real estate capital gains regime:</strong></span> Capital gains on real estate are subject to tax calculated at a rate of 19% as well as social security contributions applicable to income from assets (currently 18.6 % in total).<br />The gross capital gain is calculated as the difference between the transfer price stipulated in the deed of sale or contribution to the company and the purchase price. From this amount, the acquisition costs are deducted (these can be assessed at a flat rate of 7.5% of the purchase price).<br />In addition, construction or expansion expenses can also be deducted provided they have not already been deducted from taxable rental income.<br /><span style="color: #2b7091;"><strong>Since February 15th 2025, the amount of the purchase price must be reduced by the amount of depreciation deducted during the rental period (for taxpayers subject to the real system).</strong></span><br />The net amount of the capital gain thus determined is subject to a tax reduction based on the length of time the property has been held. This tax reduction results in a total exemption after 30 years of ownership.<br />It should also be noted that an additional tax applies to capital gains exceeding €50,000.</li><li><span style="color: #ff9900;"><strong>Capital gains subject to the professional capital gains regime:</strong></span> These capital gains are determined by the difference between, on the one hand, the sale price of the asset (or its estimated value in the event of transfer to private assets) and, on the other hand, its acquisition price reduced by the amount of depreciation applied since the beginning.</li></ul><h5><span style="color: #60bae3;">4. V.A.T:</span></h5><p>The rules for professional and non-professional renters are the same.</p><p>The rate is in principle 10%, but the furnished rentals of dwellings are exempt from V.A.T.</p><p>Only the following rentals are subject to V.A.T:</p><ul><li>Accommodation in classified residences or tourist hotels;</li><li>The provision of a furnished room with services similar to those offered by the hotel establishments (see our article named<strong><em><span style="color: #2b7091;"> &#8220;</span><a href="https://www.frenchbusinessadvice.com/vat-news-2025-finance-act" target="_blank" rel="noopener">Hotel or hotel-type accomodation services&#8221;</a></em></strong>),</li><li>Rental of bare premises to the operator of a hotel establishment.</li></ul><p>There is a VAT exemption on furnished rentals subject to this tax, when the total rent received by the lessor during the previous year does not exceed the threshold of 85,000 euros (excluding taxes).</p><h5><span style="color: #60bae3;">5. Various taxes:</span></h5><ul><li><span style="color: #ff9900;"><strong>C.F.E:</strong></span> All furnished renters are indebted. However, exemptions exist in the following cases:<ul><li>Occasional rental of part of the main residence,</li><li>Current rental of part of the principal residence at a reasonable price,</li><li>Rent of all or part of the main residence in furnished tourism. In this case the local authority may oppose the exemption.</li></ul></li><li><span style="color: #ff9900;"><strong>Taxe d’habitation sur les résidences secondaires (THRS):</strong></span> It is established in the name of the persons who have the taxable premises. It is due for all furnished residential premises other than as a principal residence, even if they are also subject to the business property tax (CFE). On the other hand, premises used exclusively for professional purposes are not subject to it.</li></ul><p>If a taxpayer requests to be relieved of the THRS, he must establish that he rented out his property for the entire year and was not able to use it outside of these periods.</p><p>Municipalities may exempt from THRS, for the portion that falls to them, furnished tourist accommodations and bed and breakfasts.<br />It should also be noted that from January 1st 2026, rural guesthouses are exempt from this tax.</p><ul><li><strong><span style="color: #ff9900;">Tax on real estate fortune (I.F.I.):</span></strong> Since the activity is not professional, the value of the premises must be included in the I.F.I base. However, in certain cases, buildings owned by the taxpayer and assigned (by him or by an intermediary company) to his furnished rental activity are totally or partially exempt from IFI if the following conditions are cumulatively met:<ul><li>the owner, a natural person, carries out this activity as his main activity and generates more than €23,000 in annual revenue;</li><li>and he withdraws from this activity more than 50% of the income of his tax household subject to income tax under the following categories: salaries and wages, industrial and commercial profits, agricultural profits, non-commercial profits, income of managers and associates.</li></ul></li></ul><h4><span style="color: #2b7091;">III-SOCIAL REGIME:</span></h4><h5><span style="color: #60bae3;">1. Activity carried out as a sole proprietorship:</span></h5><p>• <span style="color: #ff9900;"><strong>Social scheme on rental income:</strong></span></p><p>The LMNP is not subject to social security contributions on labor income if it meets the conditions set by the tax administration (income less than € 23,000 including tax and less than other professional income of the tax household).</p><p>If he is a seasonal rental company, the sole condition of achieving an annual turnover not exceeding € 23,000 is sufficient to be exempt from social security contributions on earned income.</p><p>In these two cases, the income from the furnished rental is taxed with social security contributions on income from assets (at the rate of 18.60%).</p><p>• <strong><span style="color: #ff9900;">Social regime on capital gains:</span></strong></p><p>The LMNP is taxed under the real estate capital gains regime for individuals with some particularities (see above) on real estate capital gains realized within the framework of this activity.</p><h5><span style="color: #60bae3;">2. Activity carried out in a tax-transparent company:</span></h5><p>These companies are those for which the partners are taxed with income tax on the amount of their remuneration and on their share of profit. The company is not taxed in corporation tax. This mainly concerns the partnerships (S.N.C.), the E.U.R.L. and the family S.A.R.L.</p><p>Here the criteria for distinguishing between professional and non-professional lessor are at the level of management, depending on whether it is majority manager or not.</p><ul><li>Majority managers are subject to all social security contributions from self-employed workers calculated on their share of the profit, whether or not it is distributed and, where applicable, on the remuneration allocated by the company.</li><li>Minority managers are subject to employee social security contributions excluding unemployment insurance on the basis of their remuneration. On the other hand, their share of the BIC is taxed as social security contributions on income from assets.</li><li>The other partners are taxed with social security contributions on income from assets of 18.60% on their share of BIC.</li><li>Regarding capital gains, the criteria are identical to those for furnished rentals in a sole proprietorship. It is therefore necessary to determine whether each partner is professional or non-professional according to the criteria used for the calculation of income tax (see above: Definition of L.M.N.P.).</li></ul><h5><span style="color: #60bae3;">3. Activity carried out as a company subject to corporation tax:</span></h5><p>In this hypothesis, there is no specificity linked to the furnished rental activity carried out by the company. Income and capital gains fall within the scope of corporation tax. The question of the social system is irrelevant.</p><h4><span style="color: #2b7091;">IV-THE SITUATION OF NON-RESIDENTS AT THE TAX LEVEL IN FRANCE:</span></h4><h5><span style="color: #60bae3;">1. Definition of L.M.N.P. for non-residents:</span></h5><p>The non-resident working in a sole proprietorship will have LMNP status within the meaning of income tax if he meets the following two criteria:</p><ul><li>the worldwide receipts from the furnished rental activity are less than or equal to € 23,000 including tax;</li><li>the annual income withdrawn from the furnished rental activity by all members of the tax household must not exceed the household&#8217;s other activity income, whether taxed in France or subject to an equivalent tax abroad.</li></ul><h5><span style="color: #60bae3;">2. Social scheme for rental income:</span></h5><p>As we saw above, LMNP income is not subject to social security contributions. Thus, as soon as a non-resident receives less than €23,000 from furnished rental products, he will most of the time be exempt from social security contributions. Indeed, other income from French sources is often low for non-residents.</p><p>Regarding social security contributions, people residing outside the European Economic Area or Switzerland are subject to a levy at the rate of 18.60%. On the other hand, non-professional renters who are covered by the social security regime of an EEA state (European Union, Iceland, Norway, Liechtenstein) or Switzerland, bear a levy whose rate is reduced to 7.50%.</p><p>Indeed, LMNP residing in one of these States are exempt from paying the CSG and CRDS, but remain liable for the solidarity levy.</p><h5><span style="color: #60bae3;">3. Real estate capital gains tax regime:</span></h5><p>A withholding tax at the rate of 19% is applicable on the taxable capital gain calculated according to the rules applicable for private real estate capital gains.</p><p><em>The status of L.M.N.P. responds to a very large number of particular rules that we cannot expose here in their entirety. 									<h4 class="cvGsUA direction-ltr align-center para-style-body" style="text-align: center;"><span style="color: #ff6600;"><span class="OYPEnA font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none"><span style="color: #2b7091;">1 &#8211;</span><span style="color: #ff6600;"> Lowering the exemption (franchise) threshold</span><br /></span></span><span style="color: #ff6600;"><span style="color: #2b7091;"><strong><span class="OYPEnA font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none">2 &#8211;</span></strong></span><span class="OYPEnA font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none"> Hotel or hotel-type accommodation services</span></span></h4><p><span style="color: #999999;"><em><br />Article of 15/04/2025 updated on 09/06/2025</em></span></p><p>The 2025 Finance Act established a single national exemption threshold, set at €25,000 for the previous calendar year and €27,500 for the current year, regardless of the activity carried out.</p><p>Faced with questions raised by this measure and its implementation on March 1<sup>st</sup> 2025, it was decided to suspend this reform until June 1<sup>st</sup> 2025.</p><p>Finally, the Government decided to suspend implementation of the reform until the end of 2025 in order to propose a new bill that takes into account the realities of competition and simplifies the system.</p><p>Below we provide a brief reminder, <span style="color: #ff6600;">in the first part</span>, of the current VAT exemption thresholds as well as the terms of exit from the exemption regime.</p><p><span style="color: #ff6600;">In the second part</span>, we will set out the conditions that must be met in terms of services provided to customers by a furnished rental company, in order to be subject to VAT under the hotel regime.<br /><br /></p><h3><span style="color: #2b7091;"><strong>1 &#8211; T</strong>he exemption threshold</span></h3><p>The VAT exemption applies for the current year when the turnover generated in France for the previous year is less than or equal to:</p><ul><li>€85,000 for companies engaged in trading activities or providing accommodation services;</li><li>€37,500 for companies providing services other than sales for consumption on the premises and accommodation services.</li></ul><p>If these thresholds are exceeded, the VAT exemption may continue to apply in the year in which the thresholds are exceeded, provided the &#8220;increased&#8221; thresholds are not exceeded:</p><ul><li>€93,500 for companies engaged in trading activities or providing accommodation services;</li><li>€41,250 for companies providing services other than sales for consumption on the premises and accommodation services.</li></ul><p><span style="color: #60bae3;"><strong>In addition, since January 1<sup>st</sup> 2025, the VAT exemption also applies to transactions carried out by the company in one or more Member States of the European Union (EU).</strong></span></p><p>The company will benefit from the applicable exemption regime of the Member States concerned if it meets the following conditions:</p><ul><li>not exceed €100,000 in turnover in the EU in the previous year and the current year;</li><li>provide the French administration with prior notification indicating the intention to use the VAT exemption in one or more EU Member States;</li><li>meet the conditions for application of the VAT exemption regime of the EU State(s) concerned.</li></ul><p><span style="color: #60bae3;"><strong>Consequences of the exit from the &#8220;franchise&#8221; regime:<br /></strong> <br /></span>In the event of excess of the increased threshold, the company must submit VAT on transactions carried out from the first day the threshold is exceeded. Invoices issued from this date onward must indicate the amount of VAT charged to customers.</p><p>The company is now entitled to deduct VAT on its business purchases.</p><p><span style="color: #60bae3;"><strong>What should new taxpayers do?</strong></span></p><ul><li>Check with the tax office that their VAT number is active or, failing that, request its activation and create their subscriber area in order to transmit their VAT declarations to the tax authorities (or contact an EDI partner for electronic transmission);</li><li>Update the invoicing software to remove any reference to the VAT exemption regime;</li><li>Implement processes, a management system, or an ERP system that will enable it to comply with all the VAT issues and obligations resulting from this new status as a VAT payer.<br /><br /><br /></li></ul><h3><span style="color: #2b7091;"><strong>2 &#8211; Hotel or hotel-type accomodation services</strong></span></h3><p>A large number of no-professional furnished rental companies (LMNP mainly) would like to obtain a VAT refund on their investments but are frightened by the conditions required (particularly the ancillary services to be provided) in order for their services to be subject to hotel VAT.</p><p>In fact, in addition to the usual nature of repeatedly providing rental services, the para-hotel activity is <span style="color: #ff6600;">characterized by the offer, in addition to accommodation, of at least three of the following four services:</span></p><ul><li>The cleaning of the premises must be carried out regularly. This condition will be considered satisfied when the operator simply has the means to offer such a service to the customer during their stay, at regular intervals. On the other hand, it must be considered not satisfied if the operator only cleans at the beginning and end of the stay or if it provides the customer with cleaning equipment.<br />However, it is accepted that an operator only carries out cleaning at the beginning and end of the stay provided that it has the means to offer a cleaning service at a regular frequency, provided however that the stay does not exceed 5 nights.<br /><br /></li><li>The operator must provide household linen to all tenants during their stay. It is not essential to change it regularly.<br /><br /></li><li>The operator must have the necessary resources during the rental period to offer a reception service, even if not personalized, to customers. This reception service may be entrusted to a representative who provides it in a single location separate from the premises themselves (for example, a reception service located at the entrance to the village where the rentals are located). An electronic reception system (key box) with no alternative in the form of a physical reception desk is not enough to meet this requirement.<br /><br /></li><li>The operator must have the necessary means to be able to provide breakfast to all tenants either (at the operator&#8217;s choice) in the rooms or apartments, or in a converted room located in the building or the real estate complex.</li></ul><p><span style="color: #60bae3;"><em><strong>Note:</strong> </em></span>The furnished premises must include all the furniture essential for normal occupancy by the tenant. 									<p>The withholding tax provided for in Article 182 B of the French General Tax Code (CGI) constitutes a specific tax mechanism applicable to certain non-salary income from French sources paid to companies domiciled or established outside France. This system aims to ensure taxation in France of income generated within the national territory, even when the recipient is a non-resident. This particularly concerns income derived from artistic or sporting activities, or certain commercial, industrial, or professional services. The withholding tax is made at the time the income is paid by the payer established in France.</p><p>We will examine its mechanism through the following points:</p><ul><li>What are the conditions for applying withholding tax?</li><li>How to calculate it?</li><li>Payment of the withholding tax</li><li>Withholding tax on artists&#8217; income</li></ul><p> </p><h3 style="text-align: left;"><span style="color: #2b7091;"><strong>I &#8211; The conditions for applying withholding tax</strong></span></h3><p><span style="color: #ff9900;"><em><strong>Preliminary note:</strong> </em></span>Withholding tax is applicable provided that the international agreement binding the two parties does not provide for an exemption from withholding tax. It is therefore important to check the content of this agreement before paying a service provider.</p><p>A withholding tax is applicable to services provided in France when the following three conditions are met simultaneously:</p><ul><li>The individual or company liable for the amounts in question carries out an activity in France;</li><li>The amounts are paid to a beneficiary (individual or company) subject to income tax or corporate tax in another country and who does not have a permanent business establishment in France;</li><li>These are amounts falling into one of the following categories:<ul><li>Amounts paid as remuneration for an activity carried out in France in the exercise of one of the professions whose profits fall within the category of non-commercial profits (liberal professions, offices and charges or any lucrative operations falling within this category of profits);</li><li>Products received by inventors or under copyright as well as all products derived from industrial or commercial property;</li><li>Amounts paid in remuneration for services of any kind provided or used in France (only services corresponding to actual operations are concerned);</li><li>Amounts, including salaries, corresponding to sporting services provided or used in France.<br /><em><span style="color: #ff9900;"><strong>Clarification:</strong></span></em> These benefits are subject to withholding tax on non-salary income even when they are salaries. In return, the withholding tax on salaries provided for in Article 182 A of the CGI does not apply to them.</li></ul></li></ul><p><span style="color: #60bae3;"><strong><br />Are short-term jobs that a foreign tradesperson carries out in France on behalf of a French company also subject to withholding tax? </strong></span></p><p>This type of service falls within the scope of withholding tax provided for in Article 182 B of the French General Tax Code, unless an applicable tax treaty provides for an exemption or a reduced rate.</p><p>In principle, the withholding tax applies when the service is physically provided in France. However, services provided by non-resident operators that are not royalties are generally not taxable if they do not have a physical presence in France.<br /><br /></p><h3><span style="color: #2b7091;"><strong>II &#8211; Withholding tax calculation</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;"><strong>The taxable base</strong></span></h4><p>It’s made up of the total amount of sums or products paid, excluding turnover tax.</p><p>By way of exception, a representative reduction of charges equal to 10% of the sums paid applies when the beneficiary of the payments is a legal entity or an organization whose results are not subject to income tax in the hands of a partner and whose head office or permanent establishment is located in a Member State of the European Union, in Iceland, Liechtenstein or Norway.</p><p>Regarding sporting services, as we have specified above, they are subject to withholding tax on non-salary income even when they are salaries. For the withholding tax to be payable, the sporting service must be physically performed in France or actually used in France.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;"><strong>Withholding tax rate</strong> </span></h4><p>For products referred to in Article 182 B (with the exception of sporting services), the withholding tax rate is aligned with the standard corporate tax rate, i.e. 25% for financial years beginning on or after January 1<sup>st</sup> 2022.</p><p>On the other hand, this rate is set at 15% for remuneration paid to athletes who do not have a permanent professional establishment in France.</p><p>These rates are increased to 75% when the sums in question are paid to persons domiciled or established in a non-cooperative State or territory, unless the debtor provides proof that these sums correspond to actual transactions not having the principal effect of allowing their transfer to such a State or territory.</p><p>When the paying party takes charge of the withholding, it thus becomes equal to 25/75ths of the amount actually paid to the beneficiary for sums and products subject to the rate of 25%.</p><p> </p><h3><span style="color: #2b7091;"><strong>III &#8211; Payment of the withholding tax</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;"><strong>Obligations of the debtor</strong> </span></h4><p>He is required to withhold the amount paid and remit it to the tax department responsible for collection by the 15th of the month following the calendar quarter in which the payment was made.</p><p>The payment must be accompanied by a 2494-SD declaration, available online at <em><strong><a href="https://www.impots.gouv.fr/" target="_blank" rel="noopener">www.impots.gouv.fr</a></strong></em>, showing:</p><ul><li>the identity and address of the beneficiary&#8217;s tax domicile or registered office;</li><li>the gross amount of the amounts subject to withholding;</li><li>the rate and amount of the withholding.</li></ul><p>This declaration includes all of the debtor&#8217;s beneficiaries and is accompanied by a single payment.</p><p>Payments subject to withholding tax on non-salary income must appear on the annual declaration of commissions, fees and royalties (DAS 2).</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;"><strong>Withholding tax credit</strong></span></h4><p>Except when it is applied at the increased rate of 75% on amounts and products paid in non-cooperative states or territories, withholding tax does not discharge income tax (or corporate tax). The tax remains payable according to its own rules.</p><p>Withholding tax is credited against the amount of income tax assessed on the beneficiary&#8217;s net income from French sources.</p><p>When withholding tax is lower than the amount of tax payable, the beneficiary of the amounts is liable for additional tax.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;"><strong> </strong><strong>Reimbursement of withholding tax</strong> </span></h4><p>When it is charged on income tax (or corporate tax) and its amount is greater than the amount of this tax, the taxpayer can request reimbursement of the excess withholding tax.</p><p> </p><h3 style="text-align: left;"><span style="color: #2b7091;"><strong>IV &#8211; The particularities of withholding tax on artists&#8217; income</strong><strong> </strong></span></h3><p>Amounts paid, including salaries, in consideration for artistic services are subject to a specific withholding tax. It’s due when the services are provided or used in France and paid by a debtor who carries out an activity in France to individuals or companies that do not have a permanent business establishment in that country.</p><p>This withholding tax concerns sums paid to performing artists (film actors, lyric, dramatic and choreographic artists, variety artists, performing musicians, singers, supporting artists, conductors and, for the material execution of their artistic conception, directors), whether paid directly to the artist or to an agent.</p><p>The basis is the gross amount of the amounts paid, less a 10% allowance for professional expenses.</p><p>The withholding tax rate is set at 15%.</p><p>However, international double taxation treaties may provide for exemptions.</p><p>The obligations of the paying party and the corresponding sanctions are the same as for withholding tax on non-salary income <em>(see above).</em></p><p><span style="color: #ff9900;"><strong>In conclusion</strong></span>, we remind you that before deducting tax from the foreign service provider&#8217;s invoice or paying the tax to the Treasury, it is essential to find out about the tax treaty that binds the countries of both parties to the transaction. 									<p>The Social Security Financing Act (LFSS) for 2025 introduces significant reforms, such as a reduction in employer contribution exemptions. These provisions reflect the legislature&#8217;s desire to control social and health spending while adapting financing mechanisms to current challenges.</p><p>This law is presented in three main points:</p><ul><li>Measures relating to payroll contributions</li><li>Measures relating to self-employed workers</li><li>Some miscellaneous measures</li></ul><p>It should be noted that we present below only the provisions that mainly concern companies.<br /><br /></p><h3 style="text-align: left;"><span style="color: #2b7091;"><strong>I &#8211; Measures relating to payroll contributions</strong></span></h3><h4 style="padding-left: 40px; text-align: left;"><span style="color: #60bae3;">Apprentice pay: reduction in exemptions from employee contributions and CSG/CRDS</span></h4><p>For apprenticeship contracts entered into on or after March 1<sup>st</sup> 2025, the exemption limit for employee contributions is reduced from 79% to 50% of the minimum wage (SMIC). The portion of apprentices&#8217; remuneration exceeding 50% of the minimum wage is now subject to CSG/CRDS.</p><h4 style="padding-left: 40px; text-align: left;"><span style="color: #60bae3;">General reductions in employer contributions</span></h4><p>The Social Security Financing Act organizes the merger in two stages (2025 then 2026) of general reductions in employer contributions.</p><p><span style="color: #ff6600;"><strong>As of January 1<sup>st</sup> 2025</strong></span>, the eligibility ceilings for rate reductions on employer health insurance and family allowance contributions are reduced as follows:</p><ul><li>reduction in the rate of employer health insurance contributions on salaries not exceeding 2.25 times the minimum wage (instead of 2.5 times the minimum wage);</li><li>reduction in the rate of employers family allowance contributions on salaries not exceeding 3.3 times the minimum wage (instead of 3.5 times the minimum wage).</li></ul><p><span style="color: #ff6600;"><strong>From 2026</strong></span>, reconfiguration of the reduction in employer contributions (RGCP) and elimination of the two other general reductions.</p><p>In addition, for contributions and payments due for periods of activity starting from 1<sup>st</sup> January 2025, value sharing premiums (PPV) are included in the calculation of the RGCP, both in terms of the coefficient calculation formula and the reduction basis (even for PPV amounts exempt from contributions).</p><h4 style="padding-left: 40px; text-align: left;"><span style="color: #60bae3;">Increase in the employer contribution due for free share allocations (AGA)</span></h4><p>Under certain conditions, joint-stock companies may grant bonus shares to their employees or managers, or to those of their affiliated companies, under preferential social and tax regimes.</p><p>The rate of the specific employer contribution due for AGA will be increased from 20% to 30% as of March 1<sup>st</sup> 2025.</p><h4 style="padding-left: 40px; text-align: left;"><span style="color: #60bae3;">Agricultural sector: sustainability, strengthening and extension of the TO-DE exemption</span></h4><p>Farmers hiring casual workers (TO) on fixed-term contracts may, under certain conditions, benefit from a monthly exemption from employer contributions. The maximum duration of the exemption is set at 119 working days, whether consecutive or not, for the same employee and per calendar year. Under certain conditions, job seekers (DE) are considered casual workers when they are recruited under a permanent contract by a group of employers carrying out one of the eligible activities.</p><p>The law extends the TO-DE exemption, which was due to end in December 2025. In addition, the exemption ceiling is raised from 1.20 to 1.25 times the minimum wage, retroactively from May 1<sup>st</sup> 2024.</p><p>Finally, the TO-DE exemption is extended to:</p><ul><li>agricultural equipment cooperatives (CUMA);</li><li>agricultural cooperatives and their unions, for fruit and vegetable packaging activities.</li></ul><h4 style="padding-left: 40px;"><span style="color: #60bae3;">Young innovative companies (JEI)</span></h4><p>Companies with JEI status can, subject to meeting several conditions, benefit from an exemption from employer social security and family allowance contributions.</p><p>As of March 1<sup>st</sup> 2025, the law raises the research expenditure intensity threshold to a minimum of 20% (instead of 15%) for eligibility for JEI status.</p><p> </p><h3 style="text-align: left;"><span style="color: #2b7091;"><strong>II &#8211; Measures relating to self-employed workers</strong></span></h3><h4 style="padding-left: 40px; text-align: left;"><span style="color: #60bae3;">Provisions relating to the unified social security contribution base for the self-employed</span></h4><p>The 2024 Social Security Act (LFSS) provides for a reform of social security contributions payable by non-agricultural self-employed workers not covered by the micro-social security scheme. Social security contributions are calculated on a single simplified basis corresponding to the self-employed worker&#8217;s professional income, from which professional expenses, excluding social security contributions, are deducted, and reduced by a rate set at 26%. This 26% reduction cannot be less than 1.76% nor more than 130% of the annual social security ceiling.</p><p><em>Entry into force:</em> The reform will apply from the regularization applied to contributions due for the 2025 financial year. In practice, it will therefore be implemented during the regularization of these contributions in 2026. Consequently, the provisional contributions for 2025 should be calculated on the basis of the provisions prior to the reform of the contributions base.</p><h4 style="padding-left: 40px; text-align: left;"><span style="color: #60bae3;">Provisions concerning “auto-entrepreneurs”</span></h4><ul><li><em>Gradual increase in the contribution rate for liberal self-employed workers covered by the independent regime:</em> The overall rate is raised to 23.10% on July 1<sup>st</sup> 2024, then to 24.60% in 2025 and to 26.10% in 2026.</li><li><em>Towards mandatory collection of contributions by digital platforms:</em> The 2024 Social Security Finance Act (LFSS) has established a mandatory system for digital platforms to declare and withhold social security contributions from self-employed workers covered by the micro-social security scheme who operate through their intermediary. Thus, by 2027, their social security contributions will be collected directly by the networking platforms.<br /><span style="color: #ff6600;"><strong>Clarification: </strong><span style="color: #60bae3;"><span style="color: #ff6600;">This obligation also concerns platform users who have chosen to be affiliated with the general scheme (short-term furnished rentals and rentals of movable property).</span><br /></span></span>The 2024 LFSS provided that these provisions will come into force from January 1<sup>st</sup> 2027. It also provided that this system could, however, be gradually applicable from January 1<sup>st</sup> 2026 to platform operators who meet certain criteria to be provided for by decree (according to the 2025 LFSS).</li></ul><h4 style="padding-left: 40px; text-align: left;"><span style="color: #60bae3;">Exemption from retirement contributions for certain physicians in underpopulated areas</span></h4><p>Physicians who combine full employment and retirement and practice in an area characterized by insufficient healthcare provision, are exempt (based on their professional activity as physicians) from retirement insurance contributions due on income earned in 2025.</p><p>To benefit from this exemption, their annual non-salaried professional income must be below a certain amount (set by decree). Furthermore, physicians benefiting from this contribution exemption will not accrue any basic pension rights for a second pension for the periods in question.</p><p>These provisions will only apply to physicians who have drawn their personal retirement pension before March 1<sup>st</sup> 2025.<br /><br /></p><h3><span style="color: #2b7091;"><strong>III &#8211; Some miscellaneous measures</strong></span></h3><p>Among the various measures to be noted, we cite below:</p><ul><li><span style="color: #60bae3;"><strong>Reform of compensation for functional damage linked to work accidents and occupational diseases: </strong></span>From a date to be set by decree (no later than June 1<sup>st</sup> 2025), the permanent disability pension in the event of an accidental injury (AT/MP) will compensate not only for the professional deficit, but also for the functional deficit. These increases will apply in the same way in the event of inexcusable fault on the part of the employer.<br /><br /></li><li><span style="color: #60bae3;"><strong>Change in the rules for determining “social security” staff numbers from January 1<sup>st</sup> 2025 concerning employees made available by a group of employers:</strong></span> From now on, employees made available to a company are no longer taken into account in the group&#8217;s &#8220;social security&#8221; workforce (except for AT/MP pricing). Companies hosting employees made available by a group of employers therefore continue not to include these employees in their &#8220;social security&#8221; workforce. Thus, as of January 1<sup>st</sup> 2025, employees made available by a group of employers are neither counted in the workforce of the group (except for AT/MP pricing) nor in that of the user company.</li></ul><ul><li><strong><span style="color: #60bae3;">Certificate of life to receive a retirement pension:</span></strong> To receive a retirement pension, insured persons residing abroad must provide their pension fund with a certificate of life every year. In practice, the insured must have this document completed by the French consulate or the relevant local authorities.<br />The law summarizes the methods of proving this certificate of life (in addition to the possibility of using biometric recognition):<ul><li>an automatic exchange of data between the pension-paying organization and a civil status agency in the beneficiary&#8217;s country of residence;</li><li>an on-site inspection by a trusted third-party organization;</li><li>the provision of a certificate of existence endorsed by the consular service of the beneficiary&#8217;s country of residence.</li></ul></li></ul><p>All the team of French Business Advice is at your disposal, so do not hesitate to <em><strong><a href="https://www.frenchbusinessadvice.com/contact/" target="_blank" rel="noopener">contact us</a></strong></em>!</p>								</div>

									<p><span data-olk-copy-source="MessageBody">Here are the main regulatory changes, taking account of the last France Travail reform:<br /><br /></span></p><h3 style="text-align: center;"><span style="color: #2b7091;"><strong>Capping of aid at 60% of rights</strong></span> </h3><ul><li>Regardless of your choice (ACRE or maintaining ARE)</li><li>With preservation of the remaining rights</li></ul><p aria-hidden="true"> </p><h4 style="text-align: center;"><span style="color: #60bae3;"><strong>ARCE (</strong><i><strong>Aide à la Reprise et à la Création d’Entreprise</strong></i><strong>)</strong></span></h4><p>Allows a jobseeker eligible for ARE (<i>Allocation d’aide au Retour à l’Emploi</i>) to receive in capital 60% of the remaining amount of their unemployment rights (compared to 45% before July 2023).</p><p><span style="color: #ff6600;"><strong>Payment in two installments:</strong></span></p><ul><li>The first payment (50% of the aid) is made once all eligibility conditions are met (including obtaining ACRE).</li><li>The second payment(the remaining 50%) paid 6 months later, provided the company is still active at that time.</li></ul><p><img src="https://s.w.org/images/core/emoji/16.0.1/72x72/26a0.png" alt="⚠" class="wp-smiley" style="height: 1em; max-height: 1em;" /> If a full-time permanent employment contract (CDI) is taken up in the meantime, the second payment is forfeited.</p><p><span style="color: #ff6600;"><strong>Possibility of resuming ARE rights after ARCE:</strong> </span></p><p>In case of project failure, the jobseeker can reopen their residual ARE rights. 									<p>Following our article presenting the measures in the 2025 Finance Act concerning companies, we set out below the main measures impacting individuals.</p><p>The two main measures to note this year are the introduction of a differential contribution on high incomes and the exemption from registration fees for certain cash donations.</p><p>This presentation has three chapters:</p><ul><li>Tax Calculation Measures</li><li>Measures concerning certain tax categories</li><li>Miscellaneous provisions</li></ul><p>This law also includes a number of measures that do not seem sufficiently relevant to us to be explained here, but we are obviously at your disposal to provide you with more details <a href="https://www.frenchbusinessadvice.com/contact/" target="_blank" rel="noopener"><span style="color: #2b7091;"><strong><em>on your request.</em></strong></span></a></p><p> </p><h3><span style="color: #2b7091;"><strong>I &#8211; Tax calculation measures</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;">1 &#8211; Indexation of the tax brackets</span></h4><p>All income brackets in the income tax scale, as well as their associated thresholds and limits, are increased in the same proportion as the change in the consumer price index excluding tobacco (i.e., 1.8%).</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">2 &#8211; Differential contribution on high incomes (CDHR)</span></h4><p>This contribution aims to ensure a minimum tax rate of 20% of the highest income.</p><ul><li><span style="color: #ff6600;"><em>Tax households concerned: <br /></em></span>The contribution applies to taxpayers:<ul><li>domiciled in France</li><li>whose tax household income exceeds €250,000 for single, widowed, separated, or divorced taxpayers and €500,000 for taxpayers subject to joint taxation.</li></ul></li><li><em><span style="color: #ff6600;">Calculation of income: <br /></span></em>The basis for calculating the contribution is the Reference Tax Income (RFR).<br />The RFR is reduced primarily by the following amounts:<ul><li>the amount of the €500,000 tax reduction on capital gains from the sale of securities upon retirement;</li><li>dividends for which the option to apply the scale was exercised and benefit from the 40% tax reduction;</li><li>the amount of capital gains subject to tax deferral;</li><li>the amount of capital gains and distributions subject to the levy provided for in Article 244    bis B (capital gains realized by persons not domiciled in France);</li><li>the amount of exempt profits pursuant to exemptions related to regional planning policy;</li><li>income and revenues benefiting from the expatriate regime;</li><li>net income from the granting of operating licenses, taxed at a rate of 10%;</li><li>income received by inventors upon the assignment or granting of the invention, subject to a rate of 10%;</li><li>capital gains from contributions to a company subject to corporate tax for which the tax deferral expires;</li><li>income and revenues exempt under an international double taxation convention.<br /><strong><br /><span style="color: #60bae3;">Note:</span></strong> Exceptional income is only withheld for a quarter of its amount when, by its nature, it is not likely to be collected annually and the amount exceeds the average net income on which the taxpayer was subject to income tax for the last three years.<br />Conversely, income tax relating to exceptional income is withheld for a quarter of its amount.</li></ul></li><li><span style="color: #ff6600;"><em>Calculation of the contribution: <br /></em></span>It is equal to the difference between:<ul><li>the amount resulting from the application of a 20% rate to the income defined above;</li><li>and the amount resulting from the sum of income tax plus the amount of tax reductions and credits, the exceptional contribution on high incomes, and withholding taxes.<br /><br /><strong><span style="color: #2b7091;">Taking into account family responsibilities and the marital status of taxpayers:</span> </strong>To calculate the amount of CDHR due, the second part of the difference is increased by:<br /><ul><li>€1,500 per dependent;</li><li>€12,500 for taxpayers subject to joint taxation.</li></ul></li></ul></li></ul><p style="padding-left: 40px;"><span style="color: #2b7091;"><strong>To mitigate the threshold effect, a tax allowance is applicable when the reference taxable income is between:</strong></span></p><ul><li style="list-style-type: none;"><ul><li style="list-style-type: none;"><ul><li>€250,000 and €330,000 for single, widowed, separated, or divorced taxpayers;</li><li>€500,000 and €660,000 for taxpayers subject to joint taxation.<br /><br />The tax allowance is equal to the difference, if positive, between the differential tax before the tax allowance and 82.5% of the difference between this income and €250,000 or €500,000, depending on the applicable threshold.</li></ul></li></ul></li><li><span style="color: #ff6600;"><em>Application period: <br /></em></span>The contribution is due for income tax purposes for the year 2025.<br />It gives rise to the payment of an advance payment between December 1<sup>st</sup> 2025 and December 15<sup>th</sup> 2025 equal to 95% of the amount of the contribution estimated by the taxpayer.<br /><br /></li></ul><h4 style="padding-left: 40px;"><span style="color: #60bae3;">3 &#8211; Tax reductions</span></h4><p>Various reduction schemes are extended:</p><ul><li>loc&#8217;Avantages, extended until 2027;</li><li>income tax reduction for subscriptions to the capital of press companies, extended until 2027.</li></ul><p>Other devices are created or modified:</p><ul><li><span style="color: #ff6600;"><em>Associations fighting domestic violence:</em></span> Donations to these associations will qualify for a tax credit for donations to public interest organizations at an increased rate of 75%.<br />Effective date: February 15<sup>th</sup> 2025;</li></ul><ul><li><span style="color: #ff6600;"><em>Protection of religious heritage:</em> </span>Donations to finance conservation and restoration work on religious buildings in municipalities with fewer than 10,000 inhabitants in mainland France and fewer than 20,000 overseas benefit from a tax reduction rate increased from 66% to 75% for donations made between September 15<sup>th</sup> 2023 and December 31<sup>st</sup> 2025 to the Heritage Foundation;</li><li><span style="color: #ff6600;"><em>Subscription to SME capital</em></span> &#8211; The law introduced two changes:<ul><li>increase in the tax reduction rate for cash subscriptions to innovation mutual fund units. The rate has been raised from 18% to 25%;</li><li>Removal of the income tax reduction for local investment funds (FIP) in mainland France. The system is still in force for contributions made to FIPs located in Corsica and overseas.</li></ul></li></ul><p> </p><h3><span style="color: #2b7091;"><strong>II &#8211; Measures concerning certain tax categories</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;">1 &#8211; Income from movable capital</span></h4><p>The tax regime for company founder share subscription warrants (BSPCE) is modified. We do not explain the complex principles of taxation here, but<strong><em><span style="color: #2b7091;"><a style="color: #2b7091;" href="https://www.frenchbusinessadvice.com/contact/" target="_blank" rel="noopener"> we are available to answer any questions</a></span></em></strong> you may have on this subject.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">2 &#8211; Capital gains for individuals</span></h4><p>The €500,000 deduction for retiring executives, which was due to expire on December 31<sup>st</sup> 2024, has been extended until December 31<sup>st</sup> 2031.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">3 &#8211; Salaries and wages</span></h4><p><span style="color: #ff6600;"><strong>Clarifications provided by case law on “Management packages”:</strong> </span>From now on, the tax authorities will be able to reclassify earnings resulting from &#8220;management packages&#8221; purchased by executives as salaries and wages when the benefit is in return for the duties performed within the company.</p><p>This system is applicable to transfers made from February 15<sup>th</sup> 2025.</p><p> </p><h3><span style="color: #2b7091;"><strong>III &#8211; Miscellaneous provisions</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;">1 &#8211; Registration fees</span></h4><p><span style="color: #ff6600;"><strong>Gifts of money:</strong> </span>Gifts made in full ownership to a child, grandchild, great-grandchild, or, failing such descendants, a nephew or niece, are exempt from gift tax up to a maximum of €100,000 from the same donor to the same recipient and €300,000 per recipient if these sums are allocated by the latter (no later than the last day of the sixth month following the transfer):</p><ul><li>To the acquisition or construction of their primary residence;</li><li>To work and expenses eligible for the energy renovation grant for the home they own and use as their primary residence.</li></ul><p>In the case of rental, the lease contract cannot be concluded with a member of the donatory’s tax household.</p><p><strong><span style="color: #2b7091;">Duration of application:</span> </strong>This system applies to sums paid between February 15<sup>th</sup> 2025 and December 31<sup>st</sup> 2026.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">2 &#8211; Accounts held abroad</span></h4><p>Assets in an account held abroad or in a capitalization contract or similar investment taken out abroad, <span style="color: #ff6600;"><em>&#8220;as well as digital assets in a digital asset portfolio, within the meaning of Article 1649 bis C&#8221;</em> (this reference has just been added to Article 755 of the General Tax Code)</span>, and whose origin and terms of acquisition have not been justified under the procedure provided for in Article L. 23 C of the Book of Tax Procedures, are deemed, until proven otherwise, to constitute assets acquired free of charge subject to free transfer tax at the highest rate provided for by law.</p><p>All the team of French Business Advice is at your disposal, so do not hesitate to <em><strong><a href="https://www.frenchbusinessadvice.com/contact/" target="_blank" rel="noopener">contact us</a></strong></em>!</p>								</div>

We also suggest that you <span style="color: #60bae3;"><em><strong><a style="color: #60bae3;" href="https://www.frenchbusinessadvice.com/contact/" target="_blank" rel="noopener">contact us</a></strong></em></span> if you wish to obtain details on a measure that does not appear in this document.</p><p> </p><h3><span style="color: #2b7091;"><strong>I &#8211; Determination of tax result and calculation of corporation tax</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;">1 &#8211; Furnished rentals subject to the real regime</span></h4><p>The law provides for the reintegration of depreciation allowed as a deduction from taxable profit into the basis of the taxable capital gain made on the sale of premises which have been the subject of furnished rental as part of an activity carried out on a non-professional basis.</p><p>However, the measure does not apply to depreciation relating to construction, reconstruction, expansion or improvement expenses incurred by the seller and carried out by the lessor since the acquisition of the property, when they have not been deducted from taxable income and do not have the character of deductible rental charges.</p><p><span style="color: #ff6600;"><strong>Exceptions:</strong> </span>The measure does not apply to property or rights relating to such property located in:</p><ul><li>A residence intended exclusively for students, people in training or internships, people holding a professionalization or apprenticeship contract, or people over the age of 65;</li><li>A residence with services for the elderly or disabled;</li><li>A residential facility for people who are not able to live independently.</li></ul><p><span style="color: #ff6600;"><strong>Effective date:</strong></span> February 15<sup>th</sup> 2025.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">2 &#8211; Depreciations</span></h4><ul><li>Extension until December 31th 2027 of the super-depreciation mechanism for &#8220;green&#8221; vessels.</li><li>Extension until December 31<sup>st</sup> 2030 of the &#8220;super-depreciation&#8221; of low-polluting vehicles using electricity or hydrogen:<ul><li>The scope of the measure is now limited to new vehicles using exclusively electricity or hydrogen and rates are increased.</li></ul></li></ul><p>The deduction is equal to:</p><ul><li>115% for vehicles with a maximum permissible laden weight greater than or equal to 3.5 tonnes and less than or equal to 16 tonnes;</li><li>75% for vehicles with a maximum permissible laden weight greater than 16 tonnes;</li><li>40% for vehicles with a maximum permissible laden weight greater than or equal to 2.6 tonnes and less than 3.5 tonnes.</li></ul><h4 style="padding-left: 40px;"><span style="color: #60bae3;">3 &#8211; Corporation tax</span></h4><ul><li>The law introduces, for large companies, a tax on capital reductions following the repurchase of their own shares.<br />Only companies with a turnover excluding tax, adjusted to a twelve-month period where applicable, of more than €1 billion during the last financial year are subject to this tax.</li></ul><ul><li>Introduction of an exceptional contribution on the profits of large companies for the first financial year ending on or after December 31th 2025.<br />This exceptional contribution is payable by corporation tax payers with a turnover of €1 billion or more for the financial year for which the contribution is due or for the previous financial year.</li></ul><p>We do not outline the terms and conditions of the above two measures in this article, but our chartered-accountants are available to provide details of the terms and conditions <a href="https://www.frenchbusinessadvice.com/contact/" target="_blank" rel="noopener"><span style="color: #60bae3;"><strong><em>upon request</em></strong></span></a>.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">4 &#8211; Mergers and divisions of companies</span></h4><p>The preferential regime for mergers and demergers is extended to the following transactions:</p><ul><li>mergers without an exchange of shares;</li><li>partial demergers.</li></ul><p>We do not present here the details of the conditions for obtaining the benefit of this preferential regime, but we can provide them to you upon simple request.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">5 &#8211; Agricultural taxation</span></h4><ul><li><em><span style="color: #ff6600;">Partial exemption of Precautionary Savings Deduction (DEP): </span></em>These amounts are deducted to cover potential contingencies. They are used during the ten fiscal years following the one in which the deduction was made. These amounts are then reported in the income statement for the fiscal year in which they were used or in the income statement for the following fiscal year.<br /><br />The law provides for a taxation of only 70% of their amount when they are used during the fiscal year in which one of the following risks occurs:<ul><li>The occurrence of an outbreak of animal or plant disease or an environmental incident;</li><li>Loss of crops or harvests due to damage caused by climatic hazards;</li><li>Agricultural disasters meeting the conditions for entitlement to compensation.</li></ul></li></ul><p>This system applies to income tax due for the year 2024 and subsequent years.</p><ul><li><span style="color: #ff6600;"><em>Provision for increase in the value of the stock of suckler dairy cows:</em></span> This new provision may be made for financial years ending on or after January 1<sup>st</sup> 2025 and ending December 31<sup>st</sup> 2028.</li></ul><ul><li><span style="color: #ff6600;"><em>Incentives for the transfer of farms to young farmers:</em></span><ul><li>The amount of the fixed tax allowance applicable to the capital gain on the sale of company shares in the event of a manager&#8217;s retirement is increased to €600,000 when the sale is made to:<ul><li>One or more individuals who can provide proof of receipt of aid for the establishment of young farmers;</li><li>Or a company or group in which each of the partners or members can provide proof of receipt of such aid.</li></ul></li></ul></li></ul><ul><li style="list-style-type: none;"><ul><li>Exemption from capital gains based on turnover: The revenue threshold in the event of transfer to young farmers is raised to €450,000. The capital gain will be partially exempt if annual revenue is less than or equal to €550,000.</li></ul></li></ul><ul><li style="list-style-type: none;"><ul><li>The exemption of capital gains made in the event of retirement is extended to staggered transfers in the case of transfers to young farmers.</li></ul></li></ul><ul><li style="list-style-type: none;"><ul><li>The capital gains exemption thresholds, based on the price of the assets sold, are increased in the case of transfers to young farmers.<br />The amounts of €500,000 (full exemption) and €1,000,000 (partial exemption) are increased to €700,000 and €1,200,000.</li></ul></li></ul><p>All these incentive measures concern sales made from January 1<sup>st</sup> 2025.<br /><br /></p><h3><span style="color: #2b7091;"><strong>II &#8211; Tax credits</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;">1 &#8211; Agricultural tax credits</span></h4><p>The following tax credits are extended:</p><ul><li>High Environmental Value (HVE) tax credit: through 2025;</li><li>“Farm operator replacement&#8221; tax credit: until December 31<sup>st</sup> 2027.</li></ul><h4 style="padding-left: 40px;"><span style="color: #60bae3;">2 &#8211; Changes to the research tax credit</span></h4><p>These changes are as follows:</p><ul><li>Elimination of the &#8220;young doctor&#8221; scheme;</li><li>The flat rate applied to personnel expenses for calculating eligible operating costs is reduced to 40% (instead of 43%);</li><li>Removal of certain expenses from the tax credit calculation base (mainly the costs of obtaining and maintaining certain patents).</li></ul><p><span style="color: #ff6600;"><strong>Effective date:</strong> </span>February 15<sup>th</sup> 2025.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">3 &#8211; Innovation tax credit</span></h4><p>The 30% rate is reduced to 20% and is extended until December 31<sup>st</sup> 2027.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">4 &#8211; Research tax credit in the textile sector</span></h4><p> This tax credit is extended until December 31<sup>st</sup> 2025.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">5 &#8211; Tax credit for video game development companies</span></h4><p>This credit has been extended until 2031.<br /><br /></p><h3><span style="color: #2b7091;"><strong>III &#8211; VAT</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;">1 &#8211; Rates of VAT</span></h4><ul><li><span style="color: #ff6600;"><em>Elimination of the reduced rate on gas and electricity subscriptions: </em></span>Subscriptions will therefore be subject to the standard rate (instead of the reduced rate), as will gas and electricity consumption for subscriptions relating to periods beginning on or after August 1<sup>st</sup> 2025.</li></ul><ul><li><span style="color: #ff6600;"><em>Supply and installation of boilers likely to use fossil fuels: </em></span>The Finance act stipulates that the standard rate of 20% <em>&#8220;applies to energy renovation services including the supply or installation of a boiler likely to use fossil fuels.&#8221;</em></li></ul><ul><li><em><span style="color: #ff6600;">Extension of the reduced rate of 5.5% to solar energy production equipment: </span></em>The reduced rate applies to the delivery and installation, in homes, of electricity production equipment using solar radiant energy with a power output of 9 kilowatts peak or less.<br />Effective date: October 1<sup>st</sup> 2025.</li></ul><ul><li><em><span style="color: #ff6600;">Simplification of certification for work in residential homes:</span> </em>The service provider will now only need to certify on the quote or invoice that the conditions for benefiting from a reduced rate are met.</li></ul><h4 style="padding-left: 40px;"><span style="color: #60bae3;">2 &#8211; Simplified system</span></h4><p>This system is replaced by a quarterly reporting system: the declaration must be filed every calendar quarter when the taxpayer&#8217;s turnover, plus taxable acquisitions, does not exceed:</p><ul><li>€1,000,000 during the previous calendar year;</li><li>€1,100,000 during the current year.</li></ul><p>If the threshold is exceeded, declarations will be filed monthly.</p><p><span style="color: #ff6600;"><strong>These measures will come into effect on January 1<sup>st</sup> 2027.</strong></span></p><p><strong> </strong></p><h3><span style="color: #2b7091;"><strong>IV &#8211; Miscellaneous taxes</strong></span></h3><h4 style="padding-left: 40px;"><span style="color: #60bae3;">1 &#8211; Single VAT payer (groups of companies)</span></h4><p>The law establishes an exemption from payroll tax to neutralize the consequences for employers of joining a single VAT payer.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">2 &#8211; Value-added tax for businesses</span></h4><p>The phase-out of the value-added tax for businesses has been postponed for three years. The rate reduction planned for 2025 to 2027 has been postponed to 2028 to 2030.</p><p>An additional contribution to the value added tax for companies is introduced for financial years ending on or after February 15<sup>th</sup> 2025. The basis for this contribution is the contribution on the added value of companies due for the year 2025 and its rate is 47.4%.</p><p>Taxpayers must pay a single advance payment equal to 100% of the contribution by September 15<sup>th</sup> 2025 at the latest.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">3 &#8211; Housing tax</span></h4><p>In &#8220;France Ruralities Revitalization&#8221; (FRR) zones, municipalities may, by resolution, exempt:</p><ul><li>Premises classified as furnished tourist accommodation;</li><li>Guest rooms.</li></ul><p>To benefit from the exemption, the taxpayer must send to the tax office of the location of the property, before March 1<sup>st</sup> of each year, a declaration accompanied by all the elements justifying the allocation of the premises.</p><h4 style="padding-left: 40px;"><span style="color: #60bae3;">4 &#8211; Vehicle Taxes</span></h4><p>All various vehicle taxes are being increased.</p><p>In addition, an annual tax has been created to encourage the purchase of low-emission light vehicles. This change allows you to benefit from reduced taxation with reduced reporting obligations.</p><p>By opting for the micro regime, the company is taxed on a percentage of its turnover, without having to justify its real expenses.</p><p>However, this transition must be carefully evaluated, because it involves the loss of certain advantages linked to the real regime. It is therefore essential to analyze the tax and financial impact before making this choice.</p><p>We will therefore see the following points through this study:</p><ul><li>The different reasons that lead the entrepreneur to change regime;</li><li>The formalities necessary to change regime;</li><li>The consequences of this change.</li></ul><p> </p><h3><span style="color: #2b7091;">I &#8211; The reasons for a change of regime</span></h3><h5 style="padding-left: 40px;"><span style="color: #60bae3;">&gt; Decrease in turnover below the threshold</span></h5><p>When turnover decreases and reaches an amount below the threshold for switching to the actual amount, the taxpayer will switch to the micro-enterprise regime the following year (unless opting for an actual regime).</p><h5 style="padding-left: 40px;"><span style="color: #60bae3;">&gt; The search for simplifications for the entrepreneur</span></h5><p>The micro-enterprise regime lies in administrative and accounting simplicity. It allows you to concentrate solely on the development of the activity without worrying about administrative tasks.</p><p>In fact, the micro-entrepreneur does not have to keep traditional accounts and draw up annual accounts; the taxable profit is determined by the application of a flat-rate deduction of expenses on the amount of income.</p><h5 style="padding-left: 40px;"><span style="color: #60bae3;">&gt; A sometimes advantageous amount of social security contributions</span></h5><p>Under the micro-enterprise regime, social security contributions are calculated on the amount of revenue collected at a lower rate than the actual rate.</p><p>Under a real tax regime (income tax), social security contributions are calculated on the amount of profit made.</p><p>Under a real tax regime (corporate tax), social security contributions are calculated on the amount of remuneration paid and, where applicable, on a portion of dividends.</p><p>The entrepreneur must make a choice between these various possibilities which will depend on the amount of charges, his remuneration, etc.</p><p> </p><h3><span style="color: #2b7091;">II &#8211; Formalities to be completed when changing regime</span></h3><p>The General Tax Code, article 50-0, 4 specifies: <br /><em>&#8220;Companies wishing to waive the option and which are automatically subject to the micro-BIC regime must notify their choice to the administration within the time limits applicable to the filing of the declaration submitted for the results of the year preceding that for which the waiver applies.&#8221;</em></p><p>Consequently, the operator who wishes to return to the micro regime must notify his waiver of the option for the actual regime to the tax service on which he depends within the deadlines for filing his tax return for the financial year N-1. His turnover must obviously be lower than the limits of application of the micro regime.
